Many employers have come to the conclusion that, even if they do not believe that they have behaved themselves unlawfully, or believe that they have no legal liability for terminating an employee, it is a wise business decision to offer a departing employee a severance payment in exchange for a release of liability.

In some cases, better terms of severance than what are initially offered can be negotiated with the employer.
